हेलमेट ISI मार्का नहीं पहने हो तो कटेगा चालान, नक्कालों से सावधान

1 जून 2021 से प्रभावी गैर आईएसआई हेलमेट पर पूरी तरह से प्रतिबंध लागू

कोई भी व्यक्ति जो गैर-आईएसआई हेलमेट का निर्माण, भंडारण, बिक्री या आयात करता है, उसे 1 साल तक की कैद या न्यूनतम 1 लाख रुपए का जुर्माना हो सकता है जो कि 5 लाख रुपए तक बढ़ाया भी जा सकता है।

नई दिल्ली। इस 1 जून से पूरे देश में नॉन-आईएसआई हेलमेट के उपयोग पर संपूर्ण तौर पर प्रतिबंध लागू हो चुका है और इस तरह के हेलमेट बेचने और खरीदने पर कानूनी कार्रवाई का सामना करना पडे़गा। ऐसे में ये जरूरी हो गया है कि आप जिस हेलमेट को खरीद रहे हैं, उसकी दोबारा और अच्छी तरह से जांच करें कि वह सभी मानकों पर खरा उतरने वाला आईएसआई सर्टीफिकेशन प्राप्त हेलमेट हो।

सड़क परिवहन और राजमार्ग मंत्रालय (एमओआरटीएच) द्वारा 26 नवंबर, 2020 को जारी अधिसूचना “दोपहिया मोटर वाहन सवारों के लिए हेलमेट (गुणवत्ता नियंत्रण) आदेश, 2020“ में कहा गया है कि सभी दोपहिया हेलमेट भारतीय मानक ब्यूरो (बीआईएस) प्रमाणित होने चाहिए और 1 जून से उन पर भारतीय मानक (आईएसआई) का प्रतीक लगा होना चाहिए। इस कदम के साथ भारत सरकार ने सड़क पर दोपहिया सवारों की सुरक्षा को सुनिश्चित करने का प्रयास किया है।

इस नए कानून का पालन न करने पर सख्त कदम उठाने और उल्लंघन करने वालों को दंडित करने का फेसला भी किया गया है। कोई भी व्यक्ति जो गैर-आईएसआई हेलमेट का निर्माण, भंडारण, बिक्री या आयात करता है, उसे 1 साल तक की कैद या न्यूनतम 1 लाख रुपए का जुर्माना हो सकता है जो कि 5 लाख रुपए तक बढ़ाया भी जा सकता है।

इसके अतिरिक्त, देश में केवल बीआईएस/आईएसआई सर्टीफिकेशन वाले दोपहिया हेलमेट बेचने की अनुमति होगी, जिसका अर्थ है कि नॉन-आईएसआई हेलमेट बनाना या बेचना एक अपराध है और इस का उल्लंघन करने पर जेल की सजा भी भुगतनी पड़ सकती है। भारत सरकार के इस बहुप्रतीक्षित कदम का कारण नकली और नकली दोपहिया हेलमेट की बिक्री को खत्म करना और कम गुणवत्ता वाले हेलमेट के कारण होने वाली घातक और जानलेवा सड़क चोटों के आंकड़ों को कम करना है।

डब्ल्यूएचओ की रिपोर्ट के अनुसार भारत में सड़क दुर्घटनाओं में 3 लाख से अधिक लोग हर साल मारे जा रहे हैं लेकिन इस संख्या में केवल वहीं आंकड़ा शामिल है जो भारत सरकार द्वारा रिपोर्ट और दर्ज किया गया है। इसके विपरीत सामान्य दृष्टिकोण के अनुसार भारत में सड़क दुर्घटनाओं में दस लाख से अधिक लोग मारे जा रहे हैं क्योंकि कई दुर्घटनाएं कभी रिपोर्ट और दर्ज नहीं की जाती हैं। मानव जीवन को बचाने के लिए ऐसे सुधारात्मक उपाय समय की आवश्यकता है। नियमानुसार अब इस आदेश के पालन पर सख्ती से अमल किया जाएगा। इस नियम को ना मानने वाले लोगों को कड़ी कानूनी कार्रवाई का सामना करना होगा।

सड़क सुरक्षा के क्षेत्र में काम करने वाली एक गैर-सरकारी संस्था ने कहा कि “भविष्य, एक तरह जहां बेहतर इंफ्रास्ट्रक्चर और बेहतर वाहनों की ओर देखता है, वहीं दूसरी ओर ये भी एक वास्तविकता है कि हर एक घंटे में 423 लोगों की मौत सड़क दुर्घटनाओं में होती हैं। साल 2019 में, 4,37,396 सड़क दुर्घटनाओं में 1,54,732 लोगों की मौत हुई और 4,39,262 लोग घायल हुए। चूंकि सड़क दुर्घटनाएं सभी के लिए एक प्रमुख चिंता का विषय बन गई हैं और यह सब सरकार द्वारा सड़कों पर दुर्घटनाओं को रोकने और कीमती जीवन बचाने के लिए एक बहुत ही महत्वपूर्ण कदम है।“

नए नियम के बारे में बात करते हुए, सुश्री रजनी गांधी, संस्थापक महासचिव, ट्रैक्स (ट्रैफिक रिर्फोम्स एंड एडवोकेसी एक्सपर्ट्स),-एक गैर सरकारी संगठन ने कहा कि “हेलमेट दवाओं की तरह ही जीवन रक्षक उपकरण हैं। इसलिए, यह एक बड़ा, बहुप्रतीक्षित और महत्वपूर्ण नियम है। नॉन-आईएसआई हेलमेट पर संपूर्ण प्रतिबंध आखिरकार 1 जून 2021 से लागू हो गया है। इसका मतलब है कि सड़कों पर बिकने वाले सस्ते और गैर-मानकों वाले घटिया हेलमेट अब उपलब्ध नहीं होंगे और अब इन नॉन-आईएसआई हेलमेटों की बिक्री और स्टॉक करना एक गंभीर अपराध के तौर पर दर्ज किया जाएगा।“

राजीव कपूर, प्रेसिडेंट, टू व्हीलर हेलमेट मैन्युफैक्चर एसोसिएशन ने इस नए बदलाव पर प्रतिक्रिया देते हुए कहा कि “यह नया नियम हमें अपने लक्ष्य के और करीब ले गया है और इससे भारत में दोपहिया वाहनों के उपयोग को सुरक्षित बनाने में मदद मिलेगी, क्योंकि सड़क किनारे बिकने वाले सस्ते हेलमेट जो दुर्घटना के मामले में कम या कोई सुरक्षा प्रदान नहीं करते हैं, अब बिक्री के लिए उपलब्ध नहीं होंगे। मानव जीवन को बचाने के लिए इस तरह के सुधारात्मक उपाय लागू करना समय की आवश्यकता है। सड़क दुर्घटनाओं के कारण सकल घरेलू उत्पाद का लगभग 3 प्रतिशत तक का नुकसान होता है और यह कदम निश्चित रूप से इन नुकसानों को कम करने में महत्वपूर्ण मदद करेगा। नियम का पालन करने और उल्लंघन करने वालों के लिए सख्त सजा के लिए पहले से ही सख्त प्रक्रिया है।

साथ ही, आईएसआई सर्टीफाइड हेलमेट निर्माता और बड़े संगठनों को आगे आने और इस क्षेत्र में निवेश करने के लिए प्रोत्साहित किया जाना चाहिए क्योंकि हेलमेट की मांग निश्चित रूप से बढ़ेगी। सभी मौजूदा आईएसआई प्रमाणित निर्माताओं को निश्चित रूप से एक फायदा होगा और यहां तक कि सरकार को भी इससे फायदा होगा। इस नए नियम के लागू होने से सरकार को अधिक राजस्व प्राप्त होगा क्योंकि अभी तक असंगठित क्षेत्र की कंपनियां सरकार को बहुत कम टैक्स और ड्यूटी आदि अदा करती हैं। इस बदलाव से इस सेक्टर में काफी कुछ बदलना तय है।“

इसलिए अगली बार आप जब भी कोई नया हेलमेट खरीदें तो सुनिश्चित करें कि वह बीएसआई सर्टीफाइड हो।

BLANKET BAN ON NON ISI HELMET EFFECTIVE 1ST JUNE 2021

New Delhi: If you think no one is watching your helmet then it is the high time to recheck the Helmet you are buying as w.e.f 1st June 2021 there is a blanket ban on non ISI helmets. The notification “Helmet for riders of Two Wheeler Motor Vehicles (Quality Control) Order, 2020” issued by Ministry of Road Transport and Highways (MoRTH) dated 26th November, 2020 has stated that all two-wheeler helmets must be Bureau of Indian Standards (BIS) certified and should bear the Indian standard (ISI) mark from June 1.

Non obeyance will call for strict measures and penalising the violators. Any person who manufacture, stores, sells or import a non ISI helmet will be punished with imprisonment of term that can extend to 1 years or a minimum fine of Rs. 1 lakh which can also extent to Rs. 5 lakhs.

Additionally, only the two-wheelers helmets bearing the BIS/ISI certification will be allowed to be sold in the country that means manufacturing or selling non ISI helmet is an offence and the violation can land behind the bars. The reason for this much awaited step is to eliminate the sale of spurious and fake two-wheeler helmets and minimise the fatal road injuries caused due to low quality helmets.

As per WHO report 300 thousand people are dying in road accidents in India but this number only includes what is reported and recorded by the Indian Government. On the contrary as per general view more than one million people are dying in India in road accidents because many of the accidents never get reported and recorded. Such corrective measures are need of the hour to save human lives. As per the rule now there will be strict enforcement for adherence of this order.

Mr. Sandeep Sood, Chief Trustee, Utprarit Consumer Forum – a non-government organisation working in the field of Road Safety said” While the future looks at better infrastructure and better vehicles but on another hand in every one hour, 423 road crash deaths are also a reality. In 2019, 4,37,396 Road Crashes 1,54,732 fatalities and 4,39,262 people got injured. As road accidents have become a major concern to one and all this is a very crucial step by the government to curb mishaps on roads and to save precious lives.”

Also speaking on the new rule, Ms. Rajni Gandhi, Founder General Secretary, TRAX (Traffic Reforms and Advocacy Experts), – a non-government organisation said “Helmets are life saving device just like medicines. Therefore, this is a big, much-needed and awaited rule. The ban on non ISI helmets has finally come into effect from 1st June 2021. This means that cheap and non-standardised helmets sold on the roadsides will no longer be available and now the sale and stocking of these non-ISI helmets is a criminal offence.

“This takes us one step closer to our milestone and in making two-wheeler usage safer in India as the cheap roadside helmets that offer little or no protection in case of a crash will no longer be available. Such corrective measures are need of the hour to save human lives. Approximately 3% of GDP is lost due to road accident and this step will certainly help reducing these losses. There already is strict enforcement for adherence to the rule and strict punishment for the violators. Also, ISI certified helmet manufacturers and big organisation should be encouraged to come forward and invest in this field as the demand for helmets will certainly grow. All the existing ISI certified manufacturers will certainly have an advantage and even the government will benefit out of it. This implementation will generate more revenue in terms of taxes and duty which was earlier hogged up by unorganised players commented Mr. Rajeev Kapur, President, Two wheeler helmet manufacturer association

So next time going to buy a new helmet make sure it is BSI certified only.
