सुप्रीम कोर्ट के मुख्य न्यायाधीश धनंजय वाई चंद्रचूड़ की ओर से जारी हुआ नियुक्ति आदेश
ऋतु बाहरी 16 अगस्त 2010 को पंजाब और हरियाणा उच्च न्यायालय के न्यायाधीश के रूप में नियुक्त हुईं थीं

नई दिल्ली। पंजाब और हरियाणा उच्च न्यायालय की न्यायाधीश सुश्री न्यायमूर्ति रितु बाहरी की उत्तराखंड उच्च न्यायालय के मुख्य न्यायाधीश के रूप में नियुक्त की गईं हैं।
26 अक्टूबर 2023 को श्री न्यायमूर्ति विपिन सांघी की सेवानिवृत्ति के परिणामस्वरूप उत्तराखंड उच्च न्यायालय के मुख्य न्यायाधीश के कार्यालय में एक रिक्ति उत्पन्न हुई है। इसलिए, उस कार्यालय में नियुक्ति की जानी आवश्यक है।
उच्च न्यायालय के मुख्य न्यायाधीश की नियुक्ति से संबंधित प्रक्रिया ज्ञापन का पैरा 3 निम्नानुसार प्रदान करता है।
“मुख्य न्यायाधीशों के चयन के लिए विभिन्न उच्च न्यायालयों को उचित प्रतिनिधित्व दिया जाएगा। ऐसे चयन के प्रयोजनों के लिए, न्यायाधीशों की परस्पर वरिष्ठता को उनके अपने उच्च न्यायालय में उनकी वरिष्ठता के आधार पर गिना जाएगा। नियुक्ति पर विचार मुख्य न्यायाधीश योग्यता और सत्यनिष्ठा के अधीन वरिष्ठता की कसौटी पर आधारित होंगे।”
सुश्री न्यायमूर्ति रितु बाहरी को उत्तराखंड उच्च न्यायालय के मुख्य न्यायाधीश के रूप में नियुक्त करने का प्रस्ताव है। उन्हें 16 अगस्त 2010 को पंजाब और हरियाणा उच्च न्यायालय के न्यायाधीश के रूप में नियुक्त किया गया था और वह अपने मूल उच्च न्यायालय में सबसे वरिष्ठ न्यायाधीश हैं। उच्च न्यायालय के न्यायाधीश के रूप में पदोन्नत होने से पहले, 1986 में बार में नामांकन के बाद उन्होंने उच्च न्यायालय में अभ्यास किया।
पंजाब और हरियाणा, उनका कार्यक्षेत्र नागरिक, संवैधानिक, कराधान, श्रम और सेवा मामले थे। वह सेवा और कर मामलों में विशेषज्ञता रखती थीं। 24 वर्षों की अपनी प्रैक्टिस के दौरान उन्होंने हरियाणा राज्य के लिए सहायक महाधिवक्ता, उप महाधिवक्ता और वरिष्ठ उप महाधिवक्ता के रूप में भी कार्य किया। जहाँ तक मामलों के निपटारे के माध्यम से न्यायपालिका में उनके योगदान का संबंध है, उच्च न्यायालय के न्यायाधीश के रूप में अपने 13 वर्षों के कार्यकाल के दौरान, उन्होंने 843 रिपोर्ट किए गए निर्णय लिखे, जिनमें से 247 पिछले 5 वर्षों के दौरान दिए गए थे। उन्होंने देश के सबसे बड़े उच्च न्यायालयों में से एक में न्याय प्रदान करने का व्यापक अनुभव प्राप्त किया है।
वह उच्च स्तर की सत्यनिष्ठा, आचरण और चरित्र से संपन्न एक सक्षम न्यायाधीश हैं। मुख्य न्यायाधीश के रूप में सुश्री न्यायमूर्ति रितु बाहरी के नाम की सिफारिश करते समय, कॉलेजियम ने इस तथ्य को भी ध्यान में रखा है कि पंजाब और हरियाणा उच्च न्यायालय का अधिकार क्षेत्र दो बड़े राज्यों पर है और वर्तमान में उच्च का प्रतिनिधित्व करने के लिए केवल एक मुख्य न्यायाधीश है। पंजाब और हरियाणा न्यायालय के उच्च न्यायालयों के मुख्य न्यायाधीशों में से। इसके अलावा, वर्तमान में केवल एक महिला मुख्य न्यायाधीश हैं और उनकी पदोन्नति से उच्च न्यायालयों के मुख्य न्यायाधीशों में महिलाओं का प्रतिनिधित्व बढ़ेगा।
सभी प्रासंगिक कारकों को ध्यान में रखते हुए, कॉलेजियम का मानना है कि सुश्री न्यायमूर्ति रितु बाहरी उत्तराखंड उच्च न्यायालय के मुख्य न्यायाधीश के रूप में नियुक्त होने के लिए सभी प्रकार से फिट और उपयुक्त हैं।
उपरोक्त को ध्यान में रखते हुए, कॉलेजियम यह सिफारिश करने का निर्णय लेता है कि सुश्री जे 3/3 रितु बाहरी को उच्च न्यायालय उत्तराखंड के मुख्य न्यायाधीश के रूप में नियुक्त किया जाए।
Re: Appointment of Ms Justice Ritu Bahri, Judge, High Court of Punjab and Haryana as the Chief Justice of the High Court of Uttarakhand.
A vacancy in the office of the Chief Justice of the High Court of Uttarakhand has arisen consequent upon retirement of Mr Justice Vipin Sanghi on 26 October 2023. Therefore, an appointment to that office is required to be made.
Para 3 of the Memorandum of Procedure relating to appointment of the Chief Justice of a High Court provides as under:
“A fair representation shall be given to various High Courts for selection of Chief Justices. For purposes of such selection, inter-se seniority of puisne Judges will be reckoned on the basis of their seniority in their own High Court. The consideration for appointment of Chief Justices shall be based on the criterion of seniority subject to merit and integrity.”
It is proposed to appoint Ms Justice Ritu Bahri as the Chief Justice of the High Court of Uttarakhand. She was appointed as a Judge of the High Court of Punjab and Haryana on 16 August 2010 and is the senior-most puisne Judge in her parent High Court. Before her elevation as a Judge of the High Court, after enrolment at the Bar in 1986 she practised at the High Court of
Punjab and Haryana, Her area of practice was civil, constitutional, taxation, labour and service matters. She specialized in service and tax matters. During her practice of 24 years she also served as Assistant Advocate General, Deputy Advocate General and as senior Deputy Advocate General for the State of Haryana. As regards her contribution to the judiciary by way of disposal of cases, during her tenure of 13 years as a Judge of High Court, she authored 843 reported judgments of which 247 were delivered during last 5 years. She has acquired extensive experience in dispensing justice in one of the largest High Courts in the country. She is a competent judge endowed with high level of integrity, conduct and character. While recommending the name of Ms Justice Ritu Bahri as the Chief Justice, the Collegium has also taken into consideration the fact that the High Court of Punjab and Haryana has jurisdiction over two large States and at present there is only one Chief Justice to represent the High Court of Punjab and Haryana from among the Chief Justices of the High Courts. Besides, at present there is only one woman Chief Justice and her elevation would enhance representation of women among the Chief Justices of the High Courts.
Having regard to all relevant factors, the Collegium is of the considered view that Ms Justice Ritu Bahri is fit and suitable in all respects for being appointed as the Chief Justice of the High Court of Uttarakhand.
In view of the above, the Collegium resolves to recommend that Ms J 3/3 Ritu Bahri be appointed as the Chief Justice of the High Coun Uttarakhand.
